Washington Legislation ESHB 1493 made several changes to the WA DUI laws, effective January 1, 2026.

When the WA Department of Licensing (DOL) now receives an abstract of court record for a court granted DUI/Physical Control Deferred Prosecution, the driver must surrender his/her regular driver's license and obtain a new DOL probationary license within 47 days. Failure to do so results in the driver being placed in a "Not Licensed Eligible" status until a probationary license is obtained.

In addition, a Deferred Prosecution driver's DOL license status will be suspended/revoked 3rd degree until the DOL receives proof of an installed Ignition Interlock Device(IID) in the driver's vehicle.
