Drivers facing a DUI charge in Washington may be eligible for a special one time court diversion treatment program called Deferred Prosecution, RCW 10.05.010 et. seq.
A DUI Deferred Prosecution treatment program requires the offender to successfully complete a 2 year alcohol/drug treatment program, followed by 3 years of strict court probation. There are probation monitoring fees, court costs, other fees and assessments. The DUI offender is required to have an Ignition Interlock Device installed in his/her vehicle for the first year. But no jail time, driver license suspension, criminal record or driving record.
After 5 years, the DUI charge is then dismissed by the court. Any related WA Department of Licensing administrative non refusal breath test license suspension action is also dismissed. If the DUI offender violates or fails to successfully complete the DUI Deferred Prosecution program, the court will then revoke it, find the offender guilty, and impose a DUI sentence.
